1. Acceptance of Terms

By accessing or using DrumDash, you agree to be bound by these Terms of Service. If you do not agree, please do not use the app or website.

2. Eligibility

You must be at least 13 years of age to use DrumDash. If you are under 13, you may not use the service. By accepting these terms, you represent that you are at least 13 years old and have the legal capacity to enter into this agreement.

3. License

Northshore Press LLC grants you a non-exclusive, non-transferable, revocable license to use DrumDash for personal, non-commercial purposes. This license does not grant you any right to sublicense, distribute, or create derivative works of the software.

4. User Conduct

You agree not to misuse DrumDash, including but not limited to: attempting to reverse-engineer, decompile, or disassemble the software; distributing unauthorized copies; using the service for any unlawful purpose; or interfering with the operation of the service.

5. Intellectual Property

DrumDash, including its code, design, content, features, and functionality, is owned by Northshore Press LLC and is protected by United States and international copyright, trademark, and other intellectual property laws. All rights not expressly granted are reserved.

6. User-Generated Content

Any music files, MIDI data, or other content you import into DrumDash remains your property. You represent that you own or have the necessary rights to any content you import. Northshore Press LLC does not claim ownership of your imported content.

7. Disclaimer of Warranties

DrumDash is provided "as is" and "as available" without warranty of any kind, express or implied. Northshore Press LLC disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the service will be uninterrupted, error-free, or secure.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Northshore Press LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of DrumDash, including but not limited to loss of data, loss of revenue, or equipment damage. Our total liability shall not exceed the amount you paid to use the service, if any.

9. DMCA / Copyright Infringement

Northshore Press LLC respects the intellectual property rights of others. If you believe that any content on DrumDash infringes your copyright, please contact us with the following information: (a) a description of the copyrighted work; (b) the location of the infringing material; (c) your contact information; and (d) a statement of good faith belief that the use is not authorized. We will respond to valid DMCA notices and may terminate repeat infringers.

10. Termination

We reserve the right to suspend or terminate your access to DrumDash at any time, without notice, for conduct that we believe violates these terms or is harmful to other users, third parties, or the service itself.

11. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Washington, USA, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts of Whatcom County, Washington.

12. Changes to Terms

We may update these terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of DrumDash after changes constitutes acceptance of the new terms.
